What We Do

What We Do

  • Estate PlanningWe can meet your estate planning needs, from simple wills to more complex plans involving trusts of all sorts including without limitation minor children’s trusts, credit shelter trusts, life insurance trusts, marital trusts, IRA conduit trusts, asset protection trusts, generation skipping tax trusts, spendthrift trusts, special needs planning trusts and charitable trusts.
  • Trust and Estate Administration:  We advise and guide individual and corporate fiduciaries in the administration of trusts and estates.  We also prepare and file federal estate and gift tax returns (Forms 706 and 709).  However, if the client has an experienced CPA we tend to rely on him or her to prepare these tax returns.
  • Conservatorship and Guardianship Matters: When loved ones can no longer make rational decisions for themselves or manager their own finances, we can help you set up a guardianship/conservatorship to take control of their affairs.
  • Elder Law and Medicaid Planning:  We assist clients in nursing home Medicaid planning (not emergency planning and not Veterans’ Administration benefits).
  • Business Succession Planning and General Business Work:  Businesssuccession planning fits hand in glove with estate planning.  Business succession involves many potential matters including without limitation, the transfer of the family business over time from parent to child, the sale of a professional’s interest in a professional corporation, and sales or acquisitions of closely held businesses or business interests. We prepare multiple shareholder agreements, LLC buy-sell agreements and tenants-in-common buy-sell agreements.  We organize all forms of business entities, LLCs, corporations, and family limited liability companies. And we advise family members regarding the administration of family limited liability companies and partnerships.
  •  Fiduciary Litigation:  We represent fiduciaries or beneficiaries in complicated trust and estate litigation, including breach of fiduciary duty cases, will contests, fiduciary removal cases, guardianship and conservatorship contests and contested years’ support cases. We also handle family feuds involving family limited partnerships, closely held businesses, petitions to partition family lands and life estate disputes.  And we represent Trustees before various Georgia Superior and Probate Courts in non-contested declaratory judgment actions, petitions for trust reformation, petitions for trust termination and trustee succession cases.
  • Nonprofit Work:  We assist in the formation of Georgia nonprofit entities and in their dissolution.  We advise private foundation directors and officers in their administration. And we can draft testamentary scholarship endowments and professorship chair endowments.
  • Personal Injury and Wrongful Death: Personal injury law is designed to compensate those who have been injured, physically or psychologically, because of the fault of another person or corporation. Simply stated, if you have been injured as a result of an accident which was not your fault, or not entirely your fault, you may be entitled to sue the responsible party for damages.
